CALIFORNIA CONSTITUTION, 1849.
ROSTER SIGNED AT COLTON HALL BY 1849 CONVENTION DELEGATES, PLUS SIGNATORY PAGE PREPARED FOR PRINTING.
2 remarkable documents dating from the birth of the State of California:
1. Document Signed and Inscribed by 46 members of the 1849 California Constitution, 2 pp, bifoliate leaf, Monterey, CA, September 1, 1849, light toning and spotting at edges, with mild creasing at corners, otherwise very fine.
The top of each leaf is inscribed, possibly by Marcy, the Convention's secretary: "Signatures, State where born, Residence and Age of the Delegates convened in general Convention on the 1st day of September 1849. At Monterey, to frame a State Constitution for California." Below, the state's founding fathers sign and add their information: John Sutter, born in Switzerland, now residing on "Stock farm," age 47; Robert Semple, president of the Convention, born in Kentucky, now residing in Benecia, age 42; Henry W. Halleck, born in New York, now a resident of Monterey, age as 32, etc.
2. Document Signed by 44 members of the 1849 California Constitutional Convention, 1 p, folio, Colton Hall, [Monterey, CA], "September & October 1849," likely a preliminary signatory page prepared for a printed version of Constitution, on light blue paper, with penciled annotations, light creasing, very mild foxing at lower margin, otherwise fine. Possibly prepared for publication but superceded by another (complete?) copy, the text at the upper margin reads: "Signatures of the Delegates assembled in Convention in Colton Hall September & October 1849 to form the first Constitution of California." Each signature sits on a penciled line, and spaces for the 5 who haven't signed are left marked with penciled annotations.
In preparation for statehood, California Military Governor Bennet Riley issued a proclamation in June of 1849 calling for the election of delegates to a convention designed to craft a state constitution. Riley called for the election of 37 delegates, apportioning representatives to the various settlements in California, though eventually 48 delegates would serve. Only a handful of delegates were native-born Californians, including Jose Antonio Carillo and the other Spanish-speaking representatives; the rest were from the east coast, south, and Europe.
The Convention was in session 43 days; members adopted the Constitution on October 10 and adjourned October 13. In preparation for the state's admission to the Union, the constitution clearly spells out California's identity as a free state, declaring that "all men are by nature free and independent" and that "Neither slavery, nor involuntary servitude ... shall ever be tolerated in this state."
The signatory page is signed by the following: JOSEPH ARAM, CHARLES BOTTS, ELAM BROWN, ELISHA O. CROSBY, JOSE M. COVARRUBIAS, JOSE ANTONIO CARRILLO, LEWIS DENT, PABLO DE LA GUERRA, KIMBALL H. DIMMICK, MANUEL DOMINGUEZ, ALFRED JAMES ELLIS, STEPHEN C. FOSTER, WILLIAM M. GWIN, EDWARD GILBERT, HENRY HILL, JACOB DAVID HOPPE, H.W. HALLACK, JULIAN HANKS, LANSFORD W. SHANNON, ABEL STEARNS, ROBERT SEMPLE, WILLIAM M. STEUART, M.G. VALLEJO, JOEL P. WALKER, and OLIVER M. WOZENCRAFT.
The registrar leaves are additionally signed by Julian Hanks, Henry Tefft, Myron Norton, and Thomas L. Vermeule.
The documents have descended together through an old California family with ties to the Santa Clara valley region.

(SCOTT, Winfield 1786-1866).[ Portrait ofWinfield Scott ]. New York: J. M. Clure, January 1860. India proof mezzotint engraved by T. P. Barlow after a painting by R. W. Weir, full margins (18 ½ x 15 inches, 470x380 mm). Engraved facsimile signature below the image. Matted.a striking portrait of winfield scott, hero of the mexican war. No one person, except Washington, would have more influence on the United States Army during its first hundred years of existence than General Winfield Scott. Scott played a seminal role in the military history of America, fighting in the War of 1812, the Black Hawk War, the Seminole Wars, and the Mexican War. Commanding the southern campaign of the Mexican War, Scott took Vera Cruz in March 1847 and marched to Mexico City, ending the war. This bust portrait of Scott in uniform is based on a painting done at West Point by R. W. Weir and was published in 1860, as Scott was looked to as the leader in the imminent Civil War.

A Mexican War Presentation Coin Silver Claret Pitcher, c. 1848, hallmarked Wood & Hughes, New York, retailed by Hyde & Goodrich, New Orleans, marked on the bottom "W & H" in an oval and "HYDE & GOODRICH" in a rectangle, cylindrical body with repoussé and chased grapevine above four C scroll cartouches including two lake scenes flanking presentation engraved in script "Presented to/ Captain Frederick H. Masten/ A.D.M. U.S.A./ by the undersigned Clerks and Agents in his / employ at the Depot, Quarter Master's/ office, Vera Cruz, Mexico, 22d July, 1848...", including the names of twelve clerks and agents, applied molded foot and a bifurcated hollowcast serpent handle with Meso-American mask terminal below, height 10 1/2 in., weight 29.05 troy ozs. $5000/7000 Note: The twelve clerks and agents listed on the presentation are as follows: "M. Scott, Jr., Chief Clerk; James L. Freaner Agent; Charles H. Beares, Clerk; Thos. S. King, Clerk; Sam. Carpenter Agent; Cummings Lund, Clerk; Chas. Fagot, Clerk; Geo. Shoemaker, Agt; R.G. Crozier, Clerk; Morgan L. Squires, Agt.; John Cochrane, Clk; Henry Aldrich Agent". Frederick H. Masten, to whom the pitcher is presented, was from New York and served with the First Infantry Regiment. When the Mexican-American war broke out in 1846, the 1st Infantry Regiment was sent across the border with Gen. Zachary Taylor's Army and participated in the storming of Monterrey where the Regiment fought in savage hand to hand combat. From Monterrey the Regiment was transferred to Gen. Winfield Scott's command and participated in the first modern amphibious landing in American history at Vera Cruz in 1847. By Act of Congress, Masten was appointed 2nd Lt. on Sept. 25, 1838. On Feb. 11, 1847, he was promoted from 1st Lt. to Captain at the Vera Cruz Quartermaster Depot. Interestingly, the second presenter listed on the pitcher is James L. Freaner, who was a war correspondent for the New Orleans Delta. The Mexican-American War was the first foreign war to be covered extensively by U.S. correspondents. A contemporary of the best known correspondent of the war, George Wilkins Kendall who co-founded the New Orleans Picayune, Freaner published his dispatches under the pseudonym "Mustang" and became an accomplished writer with a national reputation. He acquired his sobriquet at the Battle of Monterrey where he killed an officer of the lancers and seized his charger. In February 1848, Nicholas P. Trist, President James K. Polk's ambassador, entrusted Freaner to carry the Treaty of Guadalupe Hidalgo to Washington, D.C., a feat he accomplished in a then record seventeen days. It appears that Freaner was attached to this Quarter Master depot in Vera Cruz before and after his delivery of the Mexican-American War peace treaty. This remains the oldest treaty still in force between the United States and Mexico and as a result of it the U.S. acquired more than 500,000 square miles of valuable territory which helped it to emerge as a world power in the late nineteenth century. It is very likely that Freaner was entrusted with the commission of this pitcher since he moved correspondence back and forth to New Orleans everyday. Also of note about James L. Freaner is that he testified at the trial of Maj. Gen. Gideon Pillow, of Clifton Place plantation in Columbia, Tennessee. The charge against Pillow was "that he wrote or caused to be written, certain communications to the press at home, after the battles before the City of Mexico, arrogating to himself the chief merit, in those brilliant achievements." (Huron Reflector, Norwalk, May 9, 1849). In actuality, the letter was a forgery that had been smuggled into a package from James Freaner, without his knowledge, that was sent to the New Orleans Delta. Of the other eleven men listed as presenters, there are most certainly some biographies of note, but the story of James L. "Mustang" Freaner is so deeply entwined with the Mexican-American War that it is the most compelling to discuss here. Reference: National Archives, Washington, D.C.
